Taxi & Car Rental – Terms & Conditions –
FLUGHAFENTAXI WIEN provides services based on the following terms and conditions, service descriptions and price lists. Deviating terms and conditions do not apply, even if FLUGHAFENTAXI WIEN does not expressly oppose them. Deviations from these conditions require the express written acknowledgment of FLUGHAFENTAXI WIEN. A contract is only concluded if it is confirmed by FLUGHAFENTAXI WIEN.
Scope
The scope of service is determined exclusively by the written order confirmation of FLUGHAFENTAXI WIEN or subsidiary according to the written offer of FLUGHAFENTAXI WIEN. Information contained in brochures, service catalogs, price lists and similar information is only binding to the extent that it is expressly referred to. The transport takes place according to the regulations of the StVO and the PbefG. Passengers must adhere to the instructions of FLUGHAFENTAXI WIEN or the chauffeur. If guests act against the instructions, or if they represent a danger according to the StVO or the safety of road traffic due to impairments of the driver, FLUGHAFENTAXI WIEN is entitled to exclude them from the carriage. In this case, FLUGHAFENTAXI WIEN will charge the full fare including the fixed price or kilometer price and all ancillary and special services.
Airport pickup (airport transfer)
Any change to the agreed pick-up time, for whatever reason, must be reported to FLUGHAFENTAXI WIEN immediately. Damages due to a non-immediate notification are the responsibility of the customer.
Price
The prices include the statutory sales tax in the respective statutory amount. The prices valid on the day of the booking confirmation apply. The package prices not listed in the price list can only be agreed in writing and are only valid for the agreed date and time of rental. Additional times and distances are calculated according to the valid price list. Additional costs due to delays shall be borne by the customer, unless the delays are due to a fault of FLUGHAFENTAXI WIEN or the chauffeur. The fare includes passenger transportation with normal luggage; the transport of bulky goods requires a separate agreement.
Payment terms
FLUGHAFENTAXI WIEN reserves the right to charge a down payment of up to 50% of the total price before the start of the journey or to request a valid blank credit card issued by FLUGHAFENTAXI WIEN on a valid credit card before accepting an order. Residual payments are due within the deadlines indicated on the invoice. For the timeliness of the payment it depends on the receipt of the amount for the unconditional disposal of FLUGHAFENTAXI WIEN. When paying by check, the claim is considered to be paid only after final full credit. Payments are always used to settle the oldest claim. If the customer is in default of payment, FLUGHAFENTAXI WIEN – subject to the assertion of further damage caused by default – will charge interest at a rate of 5 percentage points above the base lending rate. For the second and each further reminder € 10, – reminder fee will be charged. The customer reserves the right to prove less damage.
Cancellations and withdrawal
Cancellations become effective only if they are made in writing or confirmed verbally by FLUGHAFENTAXI WIEN in writing. For the timeliness of written cancellations, access to FLUGHAFENTAXI WIEN is essential. Cancellations up to and including 12 hours before the contractually agreed start of the journey are free of charge. In case of cancellations, FLUGHAFENTAXI WIEN will charge a share of the basic price as damages. This share is:
* 50% for cancellations up to 6 hours
* 80% for cancellations up to 3 hours before the contractually agreed start of service
* 100% for later cancellations and no-show.
The customer is obliged if he does not find his chauffeur, be it at the airport or in the city immediately to contact FLUGHAFENTAXI WIEN or contact them. In case the customer does not answer and the chauffeur can not find the customer (or vice versa) and therefore the journey does not come about, the journey and, if given, the waiting period will be charged at 100%.
Expenses will be charged to FLUGHAFENTAXI WIEN regardless of the timeliness of the cancellations, if these have already been incurred. The customer is expressly permitted to prove that FLUGHAFENTAXI WIEN has incurred no or less damage. FLUGHAFENTAXI WIEN reserves the right to rescind the contract in whole or in part if the customer stops his payment, becomes insolvent or due to external circumstances it is assumed that the services are misused or if the customer violates his obligations under these terms and conditions.
Duties and liability of the customer
The customer shall notify FLUGHAFENTAXI WIEN immediately of any change of name, address, legal form and bank details. Likewise, the customer is obliged to provide the required information on passengers, time and place of performance. If the customer omits immediate notification, he is liable for damages that would have been avoided by timely notification. The customer undertakes not to misuse the services of FLUGHAFENTAXI WIEN, also on behalf of the passengers, in particular
* not to disturb or interfere with the performance of the service
* do not cause any damage
* not to violate criminal law
* strictly adhere to the smoking ban in vehicles
* not to refuse takeover of the fare.
If a customer violates the aforementioned obligations, FLUGHAFENTAXI WIEN is entitled to take all necessary measures to remedy the misuse. In case of culpable injury the customer is liable to FLUGHAFENTAXI WIEN for damages.
Liability of FLUGHAFENTAXI WIEN
FLUGHAFENTAXI WIEN is liable to the customer for damages – for whatever legal reason – only in case of intent or gross negligence as well as culpable violation of essential contractual obligations of FLUGHAFENTAXI WIEN, its legal representatives or vicarious agents. Liability for injury to life, limb or health is governed by statutory regulations. In case of damage to property the liability of FLUGHAFENTAXI WIEN is limited to € 1.000,00 per passenger. For the vehicles there is a liability violation according to the respectively valid general insurance conditions. For any additional insurance the customer has to take care of himself. FLUGHAFENTAXI WIEN is not liable for missed deadlines and their economic consequences, as far as these were not caused by FLUGHAFENTAXI WIEN. This includes e.g. Delays / delays caused by:
* Traffic jams, road closures
* Vehicle breakdowns or traffic accidents
* bad weather
FLUGHAFENTAXI WIEN assumes no liability towards the customer or passenger for damages resulting from faulty transmission of data by the customer.
Applicable Law and Jurisdiction
All legal relationships between FLUGHAFENTAXI WIEN and its customer are exclusively governed by Austrian law. Jurisdiction and place of fulfillment is Vienna.
Severability
Should one or more of the above conditions be ineffective, the remaining conditions remain unaffected by the ineffectiveness. In place of ineffective clauses, the legal requirements apply.
